O objetivo dessa pesquisa é analisar a maneira oficial com que o sistema de justiça criminal lida com o usuário de drogas (lei 6368/76, art. 16). Para isso, tomo como objeto de pesquisa um programa judicial de atenção ao usuário de drogas instituído pelo Tribunal de Justiça do Rio de Janeiro e supervisionado pela Vara de Execuções Penais denominado de “Programa Justiça Terapêutica da Vara de Execuções Penais do Rio de Janeiro”. A partir da descrição da atuação dos responsáveis pelo funcionamento do programa: os operadores do direito nos Juizados Especiais Criminais (JECrim) e dos profissionais da área da saúde que fazem parte da equipe da Justiça Terapêutica, a pesquisa aponta para lógicas distintas orientadoras das ações desses dois grupos de profissionais.No final, sugiro que essa ambigüidade está relacionada com o fato do próprio Estado brasileiro sobrepor estratégias de controle social distintas, observando, porém, que a lógica punitiva e repressiva prevalece no Programa Justiça Terapêutica, pois o programa estava acabando por falta de encaminhamento por parte dos JECrim. Desse modo, a natureza dos conflitos deixa de ser examinada, sendo o conflito sufocado e devolvido para o “autor do fato”. Frederico Policarpo The objective of that research is to analyze the official way with that the system of criminal justice read with the user of drugs (law 6368/76, art. 16). For that, I take as research object a judicial program of attention to the user of drugs instituted by the Tribunal of Justice of Rio de Janeiro and supervised by the Court of Penal Executions denominated of “Therapeutic Justice Program at the Penal Executions’ Court of Rio de Janeiro State”. Starting from the description of the performance of the responsible persons for the operation of the program: the operators of the right in Criminal Special Courts and of the professionals of the area of the health that are part of the team of the Therapeutic Justice, the research points for different orientates logics of the actions of those two groups of professionals. In the end, I suggest that ambiguity is related with the fact of the own Brazilian State to put upon strategies of different social control, observing, even so, that the punitive and repressive logic prevail in the Therapeutic Justice Program, because the program was ending for direction lack. In this way, the nature of the conflicts left of being examined, being the suffocated conflict and returned for the ” author of the fact “.
